In consideration of the mutual covenants herein, the parties agree:
1. Definitions
- Customer includes the person purchasing the Services or any agent or representative thereof.
- Registrant includes the person applying for a domain name or any party acting on their behalf.
- Registry means the relevant domain names Registry.
- Services means domain name registration, website hosting, email and any other service or facility provided by Estonia Mobile Apps to the Customer.
- Server means the computer server equipment operated by Estonia Mobile Apps or third party companies.
- Website means the area on the Server allocated by Estonia Mobile Apps to the Customer.
2. Domain Name Registration
- Estonia Mobile Apps does not guarantee the availability or registrability of any domain name.
- Estonia Mobile Apps will notify the Customer when domain registration is complete.
- Any action taken prior to confirmation is at the Customer’s own risk.
- Administration charges are non-refundable.
- The registration and use of domain names are subject to Registry rules and Estonia Mobile Apps General Terms.
- Estonia Mobile Apps assumes no liability for Customer’s domain usage.
- In disputes, Estonia Mobile Apps may suspend/withhold the domain or make representations to the Registry.
3. Service Availability
- Estonia Mobile Apps may suspend Services anytime without prior notice.
- Suspensions over 48 hours will be notified on a best-effort basis.
- Customer may not transfer or assign rights to any third party.
4. Content Ownership
- Customer is responsible for securing all intellectual property rights, permissions, and licenses.
- Customer data remains Customer property.
- Estonia Mobile Apps maintains confidentiality in accordance with its Privacy Policy.
Indemnity
- The Customer agrees to indemnify Estonia Mobile Apps and its staff against all claims, losses, penalties, or expenses arising from domain usage or third-party IP rights.
5. Web Design
- Estonia Mobile Apps is not responsible for losses caused by website errors or malfunctions.
- Scripts/software developed by Estonia Mobile Apps remain its copyright unless agreed otherwise.
- Customer must provide permission for copyrighted materials.
- Any additional work may incur extra charges.
- Estonia Mobile Apps is not responsible for disputes between Customer and their clients.
- Deposits: 50% for standard projects, 30% for database-driven projects. Deposits are non-refundable.
- Final payment is due upon completion; no refunds once delivered.
- Free updates provided for 1 month after completion.
6. Termination
- Estonia Mobile Apps may suspend or terminate services if payments are overdue.
- If Customer fails to rectify a breach within 30 days, Estonia Mobile Apps may terminate the agreement.
- Data may be deleted or held temporarily for recovery (subject to charges).
- Estonia Mobile Apps may display a notice of site non-availability.
7. Limitation of Liability
- Loss of profits
- Suspension or loss of domain
- Business interruption
- Access delays
- Data corruption or modification
- Events beyond Estonia Mobile Apps’ control
- Failures in domain registration processes
If Estonia Mobile Apps is held liable, maximum liability will not exceed payments made for domain registration and hosting services.
8. Notice
- Customer must comply with all domain registration laws and rules.
- Customer must keep contact details updated.
- Customer is responsible for domain renewals.
- Estonia Mobile Apps is not liable for downtime due to non-renewal.
- No compensation for third-party renewal payments.
- Illegal content must be removed within 24 hours of notice.
9. Cancellations
- Customer may cancel within 7 days by written notice.
- Refund (excluding domains) issued within 30 days.
- Domain registrations/renewals within 7 days are non-cancellable.
- Upon cancellation, Estonia Mobile Apps may delete all Customer data.
